Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Beacon mobile application and related website (together, “Beacon,” “the Service”). By creating an account or using Beacon, you agree to these Terms. If you do not agree, do not use the Service.

Who we are

Beacon is provided by Artem Kurtiak (“we,” “us,” “our”). Contact: artem@kurtiak.org.

The Service

Beacon helps you set and track personal goals for today and this week, with optional widgets and reminders. Features may change as we improve the product. We may update, suspend, or discontinue parts of the Service with reasonable notice when practicable.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Beacon. If you use Beacon on behalf of someone else, you confirm you have authority to accept these Terms for them.

Accounts

You are responsible for your account credentials and for activity under your account. Provide accurate information and keep your sign-in method secure. Notify us at artem@kurtiak.org if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that put the Service or other users at risk.

Your content

You retain ownership of the goals, notes, and other content you create in Beacon (“Your Content”). You grant us a limited license to host, store, sync, and display Your Content solely to operate and improve the Service for you. We do not claim ownership of Your Content and we do not use goal titles or notes for advertising or AI training.

You are responsible for Your Content. Do not store illegal material or content that infringes others’ rights.

Privacy

Our Privacy Policy explains how we collect and process personal data. By using Beacon, you acknowledge that policy.

Intellectual property

Beacon, including its name, logo, design, and software (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to identify the app in the ordinary course of using it.

Third-party services

Sign-in and hosting may rely on third parties (for example Apple, Google, or Supabase). Their terms and policies apply to their services. We are not responsible for third-party services we do not control.

Disclaimer of warranties

Beacon is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that goals, reminders, or widgets will always sync or display correctly. Beacon is a personal productivity tool — not medical, legal, financial, or professional advice.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of Beacon. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for Beacon in the 12 months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent allowed by law.

Indemnity

You agree to defend and indemnify us against claims arising from your misuse of Beacon, Your Content, or your violation of these Terms, to the extent permitted by law.

Termination

You may stop using Beacon and delete your account anytime in Settings → Delete account, or by emailing artem@kurtiak.org. We may suspend or end access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

App Store terms

If you downloaded Beacon from the Apple App Store or Google Play, those stores’ terms also apply. Apple and Google are not responsible for support, maintenance, or claims relating to Beacon except as required by their platform rules. In case of conflict between these Terms and mandatory platform rules, the platform rules control for that conflict.

Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms. If you do not agree, stop using Beacon and delete your account.

Governing law

These Terms are governed by the laws applicable in your place of residence to the extent required by consumer protection law; otherwise they are governed by the laws of Ukraine, without regard to conflict-of-law rules. Courts with jurisdiction over your place of residence (or as required by mandatory law) may hear disputes.
